Terms and Conditions

WELCOME TO THE HOTEL ARC-EN-CIEL GSTAAD.

We are delighted to welcome you here. To ensure that your stay is as pleasant as possible and that we can offer you the best possible service, we kindly ask you to observe the following conditions. They serve both your comfort and the smooth running of the hotel.

1. BASIC INFORMATION

These terms and conditions govern the agreements between you as a guest (customer, organizer) – hereinafter referred to as guest – and Hotel Arc-en-ciel AG (hotel). Only the terms and conditions valid at the time of conclusion of the contract apply. Deviating conditions are only valid with written consent. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected. In addition, the statutory provisions apply.

2. PLACE OF JURISDICTION / APPLICABLE LAW

The place of jurisdiction is Saanen, Canton of Bern, unless another place of jurisdiction is mandatory by law. Swiss law applies exclusively. The place of performance and payment is the registered office of the Hotel.

3. SUBJECT MATTER OF THE CONTRACT / SCOPE OF APPLICATION

Your contract for rooms, seminar rooms, or other services is concluded upon written confirmation or tacit agreement. Changes are only binding if the hotel confirms them in writing. Subletting, re-letting, and other types of use require written consent. If you book for additional guests, you are also liable for their costs.

4. SCOPE OF SERVICES

The scope of services is based on your confirmed reservation. You are only entitled to a specific room if this has been expressly agreed. If we are unable to provide a room despite a confirmed booking, we will arrange for equivalent replacement accommodation in a nearby hotel. We will cover any additional costs.

5. PERIOD OF USE

Your room will be available from 4:00 p.m. on the day of arrival and until 11:00 a.m. on the day of departure. Additional costs may be incurred for late check-out. If the room is vacated after 6:00 p.m., we will charge the full room rate.

6. OPTIONS

Option periods are binding. If the period expires without your confirmation, we may dispose of the reserved services elsewhere.

7. PRICES / PAYMENT OBLIGATION

All prices are in CHF, including VAT, excluding visitor's tax. We reserve the right to request advance payments or a credit card guarantee. Please settle the final bill by check-out in cash or with an accepted credit card.

8. CANCELLATION BY THE HOTEL

We may withdraw from the contract without incurring any costs up to 30 or 60 days prior to arrival. An
extraordinary withdrawal is possible, for example, in the event of a missing deposit, force majeure, or
incorrect information provided during the booking process.

9. CANCELLATION OF THE RESERVATION / CANCELLATION FEES

Cancellations are only effective if they are confirmed in writing. In the event of a no-show or late cancellation, up to 100% will be charged. We always endeavor to reallocate canceled services in order to reduce your costs.

10. EARLY DEPARTURE

If you leave early, we will charge you for the services booked, unless it is possible to re-let the room.

11. STAY / KEYS / INTERNET / SMOKING

Your room is reserved exclusively for registered guests. If you lose your room key, we will charge you CHF 100. Internet access is free of charge – please use your login details responsibly. Our hotel is smoke-free. Failure to comply with this rule may result in additional costs.

12. NIGHT-TIME QUIET

For the relaxation of all guests, we ask you to avoid noise between 10:00 p.m. and 7:00 a.m.

13. CONSEQUENCES OF VIOLATIONS

If your behavior affects other guests and compensation is required,
we reserve the right to charge you for the costs.

14. LEGAL BASIS FOR CLAIMS FOR DAMAGES

We are entitled to claim damages in accordance with Art. 97 and 41 of the Swiss Code of Obligations, e.g. for compensation for other guests, cleaning costs, or security services.

15. HOUSE RULES AND EXCLUSION FROM STAY

In the event of repeated or serious disturbances, we may expel guests from the premises without refunding the accommodation price.

16. GUEST'S LIABILITY FOR DAMAGES

You are liable for any damage caused by your behavior. We may charge this directly to your
credit card on file or invoice you for it.

17. ORGANIZATION OF EVENTS

On request, we can provide you with technical equipment or other facilities. You are liable for their proper use and return. Your own equipment may only be used with prior consent.

18. ITEMS BROUGHT IN BY THE GUEST

Items brought into the hotel are at your own risk. We are only liable for loss in cases of intent or gross negligence. Decorative materials must comply with fire safety regulations.

19. ACTIONS, USE, AND LIABILITY

a) Hotel: We are not liable for slight/moderate negligence; for valuables only if deposited in the hotel safe (up to CHF 1,000).
b) Guest: You are liable for damages even without proof of fault.
c) Third party: Anyone who books for you is jointly liable with you.

20. ILLNESS OR DEATH OF THE GUEST

In the event of illness, we will be happy to organize medical assistance. You are responsible for the costs. In the event of death, the contract ends automatically.

21. KEEPING ANIMALS

Animals are only allowed by prior arrangement and for a fee. Please supervise your animal at all times.

22. LOST PROPERTY

We will gladly send you any lost property upon request. The costs and risk are borne by the recipient. Storage: 6 months.

23. FURTHER PROVISIONS

We act exclusively as an agent for third-party services. Public announcements or advertising relating to the hotel require our written consent.
